Who may use our Services?
You may use our Services only if you can form a binding contract with MIS, and only in compliance with these Terms and all applicable laws. When you create your MIS account, and subsequently when you use certain features, you must provide us with accurate and complete information, and you agree to update your information to keep it accurate and complete. Any use or access by anyone under the age of 13 is prohibited, and certain regions and Content Offerings may have additional requirements and/or restrictions.
Our License to You
Subject to these Terms and our policies (including the Acceptable Use Policy, Code of Conduct, and course-specific eligibility requirements, and other terms), we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use our Services. You may download content from our Services only for your personal, non-commercial use, unless you obtain MIS’s written permission to otherwise use the content. You also agree that you will create, access, and/or use only one user account, unless expressly permitted by MIS, and you will not share with any third-party access to or access information for your account. Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access.
Changes to Content Offerings
Mind In Store (MIS) offers courses and content (“Content Offerings”) from institutions and other providers (“Content Providers”). While we seek to provide world-class Content Offerings from our Content Providers, unexpected events do occur. MIS reserves the right to cancel, interrupt, reschedule, or modify any Content Offerings, or change the point value or weight of any assignment, quiz or other assessment. Content Offerings are subject to the Disclaimers and Limitation of Liability sections.
No Academic Credit
Unless otherwise explicitly indicated by a credit-granting institution, participation in or completion of Content Offering does not confer any academic credit. Even if credit is awarded by on institution, there is no presumption that other institutions will accept that credit. You agree not to accept credit for completing a Content Offerings unless you have earned a Course Certificate or other equivalent documentation of your completion of the Content Offerings. MIS, instructors, and the associated Content Providers have no obligation to have Content Offerings recognized by any educational institution or accreditation organization.
Disclaimer of Student-Partner Relationship
Nothing in these Terms or otherwise with respect to your participation in any Content Offerings by university or company partners (“Partners”) : (a) establishes any relationship between you and any Partner; (b) enrols or registers you in any Partner institution or in any Content Offering offered by any Partner institution; or (c) entitles you to use the resources of any Partner institution beyond participation in the Content Offering.
The Services enable you to share your content, such as homework, quizzes, exams, projects, other assignments you submit, posts you make in the forums, and the like (“User Content”), with Mind In Store (MIS), instructors, coaches, and/or other users. You retain all intellectual property rights in, and are responsible for, the User Content you share. User Content does not include course content or other materials made available on or placed on to the MIS platform by or on behalf of MIS’s Content Provides or their instructors using the Services, the Content Offerings; as between MIS and its Content Providers, such Content Offerings are governed by the relevant agreements in place between MIS and its Content Providers.
How Mind In Store (MIS) and Others May Use User Content
To the extent that you provide User Content, you grant MIS a fully-transferable, royalty-free, perpetual, sublicensable, non-exclusive, worldwide license to copy, distribute, modify, create derivative works based on, publicly perform, publicly display and otherwise use the User Content. This license includes granting MIS the right to authorize Partners to use User Content with their registered students, on-site learners, or other learners independent of the Services. Nothing in these Terms shall restrict other legal rights MIS may have to User Content, for example under other licenses. We reserve the right to remove or modify User Content for any reason, including User Content that we believe violates these Terms.
We welcome your suggestions, ideas, comments, and other feedback regarding the Services (“Feedback”). By submitting any Feedback, you grant us the right to use the Feedback without any restriction or any compensation to you. By accepting your Feedback, Mind In Store (MIS) does not waive any rights to use similar or related Feedback previously know to MIS, developed y its employees or contractors, or obtained from other sources.
We care about the security of our users. While we work to protect the security of your account and related information, Mind In Store (MIS) cannot guarantee that unauthorized third parties will not be able to defeat our security measures. Through the Services, you will have the ability to access and/or use content provided by instructors, other users, and/or other third parties and links to websites and services maintained by third parties. Mins In Store (MIS) cannot guarantee that such third-party content, in the Services or elsewhere, will be free of material you may find objectionable or otherwise inappropriate or of malware or other contaminants that may harm your computer, mobile device, or any files therein. MIS disclaims any responsibility or liability related to your access or use of, or inability to access and use, such third-party content.
Mind In Store (MIS) respects the intellectual property rights of our users, Content Providers, and other third parties and expects our users to do the same when using the Services. We have adopted and implemented the MIS Copyright and Trademark Policy in accordance with applicable law, including the MCMC Act.
We are constantly changing and improving our Services. We may add or remove functions, features, or requirements, and we may suspend or stop part of our Services altogether. Accordingly, Mind In Store (MIS) may terminate your use of nay Services for any reason. If you use od a paid Service is terminated, a refund may be available under our Refund Policy. We may not be able to deliver the Services to certain regions or countries for various reasons, including due to applicable export control requirements or internet access limitations and restrictions from governments. None of MIS, its Content Providers and coaches, instructors, its contributors, sponsors, and other business partners, and their employees, contractors, and agents (the “MIS Parties”) shall have any liability to you for any such action. You can stop using our Services at any time, although we’ll be sorry to see you go.
As a coach, you are contracting directly with Mind In Store, regardless of whether another Mind In Store subsidiary facilitates payments to you.
As a coach, you are responsible for all content that you post, including lectures, quizzes, coding exercises, practice tests, assignments, resources, answers, course landing page content, and announcements (“Submitted Content”).
You represent and warrant that:
- You will provide and maintain accurate account information;
- Your Submitted Content will not infringe or misappropriate any third party’s intellectual property rights;
- You have the required qualifications, credentials, and expertise (including education, training, knowledge, and skill sets) to teach and offer the services that you offer through your Submitted Content and use of the Services; and
- You will respond promptly to Students and ensure a quality of service that corresponds with the standards of your industry and instruction services in general.You warrant that you will not:
- Post or provide any inappropriate, offensive, racist, hateful, sexist, pornographic, false, misleading, incorrect, infringing, defamatory or libelous content or information;
- Post or transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, or any other form of solicitation (commercial or otherwise) through the Services or to any user;
- Use the Services for business other than providing tutoring, teaching, and instructional services to students;
- Engage in any activity that would require us to obtain licenses from or pay royalties to any third party, including the need to pay royalties for the public performance of a musical work or sound recording;
- Frame or embed the Services (such as to embed a free version of a course) or otherwise circumvent the Services;
- Impersonate another person or gain unauthorized access to another person’s account;
- Interfere with or otherwise prevent other coaches from providing their services or courses; or
- Abuse Mind In Store resources, including support services.
License to Mind In Store
Unless otherwise agreed, you have the right to remove all or any portion of your Submitted Content from the Services at any time. Except as otherwise agreed, Mind In Store’s right to sublicense the rights in this section will terminate with respect to new users 60 days after the Submitted Content’s removal. However, (1) rights given to students before the Submitted Content’s removal will continue in accordance with the terms of those licenses (including any grants of lifetime access) and (2) Mind In Store’s right to use such Submitted Content for marketing purposes shall survive termination.
We may record all or any part of your Submitted Content for quality control and for delivering, marketing, promoting, demonstrating, or operating the Services. You grant Mind In Store permission to use your name, likeness, voice, and image in connection with offering, delivering, marketing, promoting, demonstrating, and selling the Services, your Submitted Content, or Mind In Store’s content, and you waive any rights of privacy, publicity, or other rights of a similar nature, to the extent permissible under applicable law.
Trust & Safety
3.1 Trust & Safety Policies
You agree to abide by Mind In Store’s Trust & Safety policies, Restricted Topics policy, and other course quality standards or policies prescribed by Mind In Store from time to time. You should check these policies periodically to ensure that you comply with any updates to them. You understand that your use of the Services is subject to Mind In Store’s approval, which we may grant or deny at our sole discretion.
We reserve the right to remove courses, suspend payouts, and/or ban coaches for any reason at any time, without prior notice, including in cases where:
- A course falls below our quality standards or has a negative impact on the student experience
- A coach engages in behavior that might reflect unfavorably on Mind In Store or bring Mind In Store into public disrepute, contempt, scandal, or ridicule;
- A coach engages the services of a marketer or other business partner who violates Mind In Store’s policies; or
- As determined by Mind In Store in its sole discretion.3.2 Co-Coaches and Teaching Assistants
Mind In Store platform allows you to add other users as co-coaches or teaching assistants for courses that you manage. By adding a co-coach or teaching assistant, you understand that you are authorizing them to take certain actions that affect your Mind In Store account and courses. Mind In Store is not able to advise on any questions or mediate any disputes between you and such users. If your co-coaches have an assigned revenue share, their share will be paid out of your earned revenue share based on the ratios you have specified in your Course Management settings as of the date of the purchase.
3.3 Relationship to Other Users
Coaches don’t have a direct contractual relationship with students, so the only information you’ll receive about students is what is provided to you through the Services. You agree that you will not use the data you receive for any purpose other than providing your services to those students on the Mind In Store platform and that you won’t solicit additional personal data or store students’ personal data outside the Mind In Store platform. You will indemnify Mind In Store against any claims arising from your use of students’ personal data.
When creating a course, you will be prompted to select a base price (“Base Price”) for your course. Alternatively, you may choose to offer your course for free.
You give us permission to share your courses for free with our employees, with selected partners, and in cases where we need to restore access accounts who have previously purchased your courses. You understand that you will not receive compensation in these cases.
5.1 Revenue Share
When a student purchases your course, we calculate the gross amount of the sale as the amount actually received by Mind In Store from the student (“Gross Amount”).
Your revenue share will be 75% of the Net Amount less any applicable deductions, such as student refunds. If we change this payment rate, we will provide you 30 days notice using prominent means, such as via email or by posting a notice through our Services.
Mind In Store makes all coach payments in Malaysian Ringgits (MYR) regardless of the currency with which the sale was made. We will assume transaction processing fees, excluding foreign currency conversion fees and wiring fees. Your revenue report will show the sales price (in local currency).
5.2 Receiving Payments
For us to pay you in a timely manner, you must own a banker account in good standing and must keep us informed of the correct email associated with your account. You must also provide any identifying information. We reserve the right to withhold payments or impose other penalties if we do not receive proper identifying information from you. You understand and agree that you are ultimately responsible for any taxes on your income.
Depending on the applicable revenue share model, payment will be made every 15th and 30th of the month in which (a) we receive the fee for a course and the courses has due or (b) the relevant course consumption occurred.
We reserve the right not to pay out funds in the event of identified fraud, violations of intellectual property rights, or other violations of the law.
You acknowledge and agree that students have the right to receive a refund. Coaches will not receive any revenue from transactions for which a refund has been granted.
If a student asks for a refund after we have paid the relevant coach payment, we reserve the right to either (1) deduct the amount of the refund from the next payment sent to the coach or (2) where no further payments are due to the coach or the payments are insufficient to cover the refunded amounts, require the coach to refund any amounts refunded to students for the coach’s courses.
While you are a published coach and subject to the requirements below, you may use our trademarks where we authorize you to do so.
- Only use the images of our trademarks that we make available to you, as detailed in any guidelines can refer to firstname.lastname@example.org;
- Only use our trademarks in connection with the promotion and sale of your Mind In Store courses or your participation on Mind In Store; and
- Immediately comply if we request that you discontinue use.
You must not:
- Use our trademarks in a misleading or disparaging way;
- Use our trademarks in a way that implies that we endorse, sponsor, or approve of your courses or services; or
- Use our trademarks in a way that violates applicable law or in connection with an obscene, indecent, or unlawful topic or material.
Deleting Your Account
We’ll use commercially reasonable efforts to make any remaining scheduled payments that are owed to you before deleting your account. You understand that if students have previously enrolled in your courses, your name and that Submitted Content will remain accessible to those students after your account is deleted. If you need help or encounter difficulty deleting your account, you can contact us at email@example.com.
Miscellaneous Legal Terms
8.1 Updating These Terms
From time to time, we may update these Terms to clarify our practices or to reflect new or different practices (such as when we add new features), and Mind In Store reserves the right in its sole discretion to modify and/or make changes to these Terms at any time. If we make any material change, we will notify you using prominent means such as by email notice sent to the email address specified in your account or by posting a notice through our Services. Modifications will become effective on the day they are posted unless stated otherwise.
Your continued use of our Services after changes become effective shall mean that you accept those changes. Any revised Terms shall supersede all previous Terms.
Any version of these Terms in a language other than English is provided for convenience and you understand and agree that the English language will control if there is any conflict.
8.3 Relationship Between Us
You and Mind In Store agree that no joint venture, partnership, employment, contractor, or agency relationship exists between us.
Mind In Store will not be held for responsible shall the individual course content infringed or violated laws and regulation of the country.

This privacy notice for personal data (“Privacy Notice”) is issued to all visitors of this website or persons who have registered their interest to use our services, pursuant to the statutory requirements of the Personal Data Protection Act 2010 (“PDPA”).
During your course of dealings with us, we will collect and process your personal data that includes, but is not limited to, your name, age, occupation, residential and/or office address, contact number, email address, and the organization or entity you represent.
We collect and process your personal data in order to communicate with you, respond to your enquiries, provide you with information and updates on our services and promotions offered by us and selected third parties, to ensure that the information you provide is correct, and any other purposes required to operate and maintain our business (collectively referred to as “Purposes”).
We will not disclose any of your personal data to any third party without your consent except to Mind In Store – our lead management system, our professional advisers, vendors, suppliers, agents, contractors, service providers, business partners, insurance companies, banks and/or financial institutions, within or outside Malaysia, where necessary, for the Purposes mentioned above, to any party who undertakes to keep your personal data confidential, or to whom we are compelled or required under the law to disclose to.
If you do not provide us with your personal data, or do not consent to this Privacy Notice, you will not be able to receive further communications from us.
We are committed to ensuring that your personal data is stored securely. You have the right to request for access to, request for a copy of, and request to update or correct your personal data held by us. You also have the right at any time to request us to limit the processing and use of your personal data (for example, requesting us to stop sending you any marketing materials or contacting you for marketing purposes), including personal data which may be derived or inferred from your personal data, subject to our right to rely on any statutory exemptions and/or exceptions to collect, use and disclose your personal data.
By providing your personal data to us, you consent to us processing your personal data in accordance with this Privacy Notice, and you confirm that all personal data provided by you is accurate and complete, and that none of it is misleading or out of date.
